Terms of Service

These Customer Terms and Conditions (this "Agreement"), effective as of the date on which you click a button or check a box (or something similar) acknowledging your acceptance of this Agreement (the "Effective Date"), is by and between OnlyFans Gigs and the entity on whose behalf the individual accepting this Agreement accepts this Agreement ("Customer"). The individual accepting this Agreement hereby represents and warrants that it is duly authorized by the entity on whose behalf it accepts this Agreement to so accept this Agreement. OnlyFans Gigs and Customer may be referred to herein collectively as the "Parties" or individually as a "Party." The Parties agree as follows:
1: Entity Definitions
- User refers to any singular or joint entity accessing this web application platform, irrespective of them being a Customer or a Subscriber.
- Talent refers to any user who comes upon the platform in search of a gig or a job (or its equivalent).
- Job-Seeker refers to the same entity as a Talent.
- Gig-Seeker refers to the same entity as a Talent.
- Individual refers to the same entity as a Talent.
- Subscriber refers to the Talents who sign up to recieve newsletters and have their data registered for access by Agencies.
- Specialist refers to special industry veterans who are skilled in AI Influencer creation, AI Model creation, UX, website design, banner postings, traffic management, etc.
- Agency refers to any user who comes upon the platform with the purpose of hiring Talents. Note that the scope of the term is not restricted to literal Agencies.
- Customer refers to any user who pays for the site's services in any scope.
- Agency Customer refers to any Agency who pays for the site's services in any scope.
- Priority Customer refers to very specific Agencies whose purchases form a large part of the site's revenue, which requires OnlyFans Gigs to service them with critical importance.
- Internal Team Member refers to any or all team members within the company of OnlyFans Gigs.
- Support Team Member refers to the Support Team members within the company of OnlyFans Gigs.
- Sales Team Member refers to the Sales Team members within the company of OnlyFans Gigs.
- Tech Team Member refers to the Tech Team members within the company of OnlyFans Gigs.
2: Data Definitions
- Customer Data refers to any data collected from the customer with their consent.
- Analytics Data refers to the data collected for the job listings set up by an Agency.
- Internal Data refers to the data collected by the site for the purpose of analytics.
- Private Data refers to Internal Data that cannot be made available to Agencies upon request.
- Sales Data refers to data OnlyFans Gigs showcases to illustrate customer acquisitions to leads.
3: Platform Definitions
- Platform refers to the web application being accessed by the users.
- Scraper refers to the in-house utility used by OnlyFans Gigs for scraping data from different sources.
- Internal Analytics refers to the in-house utility used by OnlyFans Gigs to access Internal Data.
- OnlyFans refers to the site that the reader is expected to know about before perusing the Legal section.
4: Monetary Definitions
- Listing Fee refers to the charges paid by an Agency to buy a gig listing on the platform.
- Newsletter Fee refers to the fees charged to subscribers for getting newsletters delivered to them weekly for notifying them about gigs. As of date, newsletters are free and the fee is zero.
- Database Fees refers to the fees charged to provide Agencies access to Talent and Specialist data.
5: For Listings
- Term of Existence: A listing is purchased, by default, for a month. After the end of the said duration, the listing shall be removed from the platform unless it is repurchased.
- Extended Term: A listing may be purchased for a greater duration than a month as confirmed by the Sales Team. Such services occur at a discounted price, but not negotiable.
- Retirement of a Listing: A listing may be retired after a suitable candidate has been found by the Agency to satisfy their requirements. In no such cases will OnlyFans Gigs be liable to issue a refund for the Listing Fees.
- Removal Upon Compliant: OnlyFans Gigs reserves the right to expel a posting from their platform if they deem it predatory and spam in nature. Such occurences only occur if OnlyFans Gigs recieves compliants via emails with proofs. In such a case, the original Agency is communicated with the allegations and proofs. OnlyFans Gigs reserves the right to then immediately discard the listing without any reimbursements of the listing fee.
- Removal Upon Misconduct: OnlyFans Gigs reserves the right to expel a posting from their platform if the Agency involved faces public backlash due to exploitative malpractices of any nature. This is a failsafe measure to prevent platform defamation. To ensure fairness, there would be opportunities for Agencies to justify their alleged actions. The decision to retire the posting shall rest solely in the hands of OnlyFans Gigs afterwards. However, such cases have not yet occurred in history of the company.
- Analytics: Metrics for number of click per posting and the timestamp of clicks are provided to Agencies to gauge their engagement. This data is delivered as an XLS or a CSV via emails on contacting support.
- No Refunds: No refunds shall be issued once a listing has been purchased under any circumstance.
6: For Data Dumps
- Delivery: A data dump, once purchased, will only contain a set amount of data. It will not increase dynamically with the increase in platform subscriptions. It will contain data as of the timestamp on which the purchase would be made. Format would be CSV or XLS and it shall be emailed.
- Extended Subscription: Upon request, the Sales Team can provide access to an extended subscription that allows for dynamic data dumps with a monthly or yearly validity.
- Data: Each row of data shall contain the name of the talent, their preferred role, a short note about them and their primary social as mandatory fields. They may choose to include their contact and email too (which is neither guaranteed nor recommended by OnlyFans Gigs).
- Talent Database: It has the data of all users accessing this page who choose to be open to having their profiles viewed. They are open for work and would be great up and coming assets. It is unmonitored.
- Specialist Database: It has all the data procured by our Internal Talent Team. It is 100% foolproof and contains industry specific individuals who have worked in this niche for a while. Examples: AI Influencer Creator, AI Model Creator, OnlyFans web designers, DCMA regulators, etc.
- Misdemeanour: Misconduct is seriously addressed by the platform's Regulations and Compliance teams. Any false practices perfomed with the user data collected by the platform besides the purposes of recruitment for gigs would result in permanent blacklisting.
- Subscription Loss: Permanent blacklisting would lead to loss in extended subscriptions in the platform with no refunds. They shall also be communicated with the proof of such misconduct that has resulted in them being blacklisted for clarity and fairness.
- Sales Data Sharing: It is expected by a Customer Agency to realise that OnlyFans Gigs deems it appropriate to share Customer Agencies' identities and any records proving the same in the events of customer acquisition. OnlyFans Gigs is free to make such data available to third parties including its other customers in compliance with applicable law, and use such data to the extent and in the manner permitted under applicable law.
- No Refunds: No refunds shall be issued once a data dump has been purchased under any circumstance.
7: For Newsletters
- Delivery: A Newsletter is an optional offering a Talent may subscribe to to get periodic email updates regarding new listings.
- Experimental Nature: This feature is new and experimental. The motive behind this is to boost site visits and click-throughs.
- Pricing: As of date, this remains free as part of our commitment of high quality of service to Talents. This may change in the future.
- Optional Nature: While subscribing to the platform, a Talent is given the choice to sign up for free newsletters.
- Period: Emails would be sent out on a weekly or biweekly basis depending on the state of the listings.
8: Suspension
Notwithstanding anything to the contrary in this Agreement, OnlyFans Gigs may temporarily suspend users' access to any portion or all of the services if they reasonably determine that there is a threat or attack on any of the OnlyFans Gigs' IP. Furthermore, services may be temporarily suspended in case of any unforeseen security breaches that may bring down the servers (such as a D-DoS attack). The platform may also be disbanded temporarily in the events of server maintenance. Besides any such unforeseen (and extremely rare) outages, there may be events of shifting or rearchitecting technical infrastructure that may lead to a few offline hours.
9: Support
Throughout the application lifetime, OnlyFans Gigs will use commercially reasonable efforts to provide users with basic customer support via support email channels during the Support Team's normal business hours. Please see the Support Policy for more details.
10: Publicity
OnlyFans Gigs may identify Customer as a user of the services and may use their name, logo, and other trademarks in OnlyFans Gig's customer list, press releases, blog posts, advertisements, and website (and all use thereof and goodwill arising therefrom shall inure to the sole and exclusive benefit of Customer). Otherwise, neither Party may use the name, logo, or other trademarks of the other Party for any purpose without the other Party's prior written approval.
11: Severability
If any provision of this Agreement is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability will not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. Upon such determination that any term or other provision is invalid, illegal, or unenforceable, the Parties shall negotiate in good faith to modify this Agreement so as to effect their original intent as closely as possible in a mutually acceptable manner in order that the transactions contemplated hereby be consummated as originally contemplated to the greatest extent possible.
12: Force Majeure
In no event shall either Party be liable to the other Party, or be deemed to have breached this Agreement, for any failure or delay in performing its obligations under this Agreement (except for any obligations to make payments), if and to the extent such failure or delay is caused by any circumstances beyond such Party's reasonable control, including but not limited to acts of God, flood, fire, earthquake, explosion, war, terrorism, invasion, riot or other civil unrest, strikes, labor stoppages or slowdowns or other industrial disturbances, or passage of law or any action taken by a governmental or public authority, including imposing an embargo.
13: Feedback
If a user or any of its employees or contractors sends or transmits any communications or materials to OnlyFans Gigs by mail, email, or otherwise, suggesting or recommending changes to the OnlyFans Gigs' IP, including without limitation, new features or functionality relating thereto, or any comments, questions, suggestions, or the like, OnlyFans Gigs' is free to use such Feedback irrespective of any other obligation or limitation between the Parties governing such Feedback so long as OnlyFans Gigs' does not identify the User as the source of the Feedback without their prior approval.
14: Payments
As of date, all payments made to the purchases of all or any Services in the platform shall be made via platforms such as PayPal and Wise, upon the joint agreement of the same by both concerned Parties. OnlyFans Gigs is currently working on establishing portals and pipelines to support more options.
15: Agreement Amendment
OnlyFans Gigs may change this Agreement from time to time at its discretion. The date on which the Agreement was last modified will be updated at the top of this Agreement. OnlyFans Gigs will provide any active Customer with reasonable notice prior to any amendments or modifications taking effect via emails. If Customer accesses or uses the Services after the effective date of the revised Agreement, such access and use will constitute Customer's acceptance of the revised Agreement beginning at the date of enforcement of the Agreement.
